Legal Question in Credit and Debt Law in New Jersey

I was contacted by phone a few days ago by JBC Legal Group stating that I had a returned check to a major chain drugstore from 4-14-2000. We told the man that we would be glad to pay it if he could mail us a bill or statement. He became very rude and yelled at us and said it didn't matter that it was in litigation. I called the company back today and got another rude woman who said I had to Western Union immediately. I asked her nicely to send a bill or copy of the check and she refused saying it was beyond that point and I needed to send money immediately. I explained that I was skeptical and felt I might be scammed and she yelled at me and still refused to send or fax anything. I asked for their address and she hung up on me. My husband called right back and explained to the next person on the phone the same thing and they were rude and refused to cooperate. Is this legal? I am willing to take care of my debts and certainly don't want a day in court or jail, but why would they refuse to provide me with proof of debt. They don't even say the little ''attempt to collect a debt speech'' that other collection agencies always use. I don't know what to do! Please advise ASAP. Thank You.

From your information, it appears the debt collectors may have violated Federal law as well as Georgia law in collecting the debt. I would like to know more to be able to tell you if the violations are egregious enough to warrant a lawsuit against the debt collector. These cases are taken on a contingency basis so you do not have to pay the attorney's fees. With an attorney on the case, the debt collector will stop contacting you; however, if you really want to pursue the matter, it is best to do so to the end. Whether you have a legitimate debt does not matter, it only matters in the methods the debt collectors use to collect the oustanding debt. It is best if you contact an attorney to provide more information on the case.

These guys apparently just don't care and violate the Fair Debt Collection Practices Act on a regular basis. Many State Attorney Generals are investigating them. They are located in NJ. Be aware that the time for you to institute suit under the FDCPA is one year from the date of the violation. If you win, you are entitled to any actual damages, statutory damages up to $1,000 and attorney's fees (if you use an attorney). Feel free to call me if you need additional info at 973-659-9045.
