Judgement served on spouse ?

Can a spouse be sued for debts that are NOT in his/her name ? Specifically, in this case, a husband is being sued for the debts of his wife. The debt originates from the wife's prior divorce law firm, and the current husband's (then boyfriend) name is not on any legal documents as a co-signer or anything of that nature. However, the law firm has filed a suit against the wife AND her current husband in hopes of obtaining judgements against BOTH of them for the balance of fees still owed.

Is this legal ? How can a husband in a non-community property state be sued for debts that are NOT his own or joint ?

I don't know of any reason to sue the new husband under the circumstances stated. A husband can be liable for the debts of a spouse incurred during a viable marriage if the debt is for a necessity like medical bills. If you would like to discuss this further, you can reach me at 732-545-9292.
