Legal Question in Credit and Debt Law in New Jersey
Need help with judgment
I have a default judgment from 2001 now im trying to refinance my house and cant get around paying it is there anyway to get it removed besides settling? the judgement isnt on my credit report just public record. The judgement arose from a car that was purchased when i was 18 and stolen in 1997, no insurance. I was in the us navy and bought the car in mississipi, drove it to california and it was stolen not long after. I then went to virginia and didnt pay for the car anymore. If the finance co. that i used isnt in business anymore do i still owe them? Help please.

Re: Need help with judgment
Unfortunately you are going to have to satisfy the debt.
No mortgage company will lend you $$$ for fear that the judgment lien will have priority status over their lien (the mortgage).
They want to lend against a clear title and not one clouded by liens.
The good news is that you can potentially negotiate a settlement with the creditor for less than the full amount due.
Ensuring that a lien is successfully released can be tricky business, you should seek the advice of an attorney in this matter (either me or someone else).
