Legal Question in Credit and Debt Law in New Jersey

Legal time frame for issuing an invoice

I just received an invoice from a hospital for the birth of my daughter who just turned 1. Is there a legal time frame for issuing an invoice? It was dated one day before her first birthdate, but received 4 days after.

Re: Legal time frame for issuing an invoice

The statute of limitations in NJ for collecting a debt is six years. Thus, the hospital is well within the time to attempt to collect. I have seen the argument made that a medical provider is barred from collecting on a debt where a more timely billing would have allowed for the payment by an insurance company but the delay has now barred payment from that company. This argument has varying degrees of success depending on other facts and circumstances. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since you have not retained an attorney in this case, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010.
