Legal Question in Credit and Debt Law in New Jersey

Money owed on leased vehicle after death

My husband leased a car and then passed away. I called the automotive company and was told I didn't own car and would have to pay 300. and complete all documents in order to retain car. Went to dealership which leased us car and they said ''No problem'' turn the car in and lease one under your name. I did this. Now the dealership is asking for 3100 and is saying the estate owes this because it is the difference between the value of the car and what they received at auction. I contacted them many times and contacted the dealership. The automotive company - Chrysler - apologizes but says they can't do anything about it. Would contacting my lawyer help? or must I pay this money? Absolutely NO one told me this would be a problem and it is obvious that the dealership took advantage of me - the widow at this time. I wrote to the better business bureau in NJ. At this point I haven't heard from dealership.

Any assistance would be appreciated.

Re: Money owed on leased vehicle after death

I'm confused when you say you have an attorney. Do you have one on retainer? How much will it cost you to speak with him or her? If you already have one, I would direct all questions to your attorney. Your attorney could speak with the dealership and try to hammer things out with them. Its not worth it for either side to litigate this situation. For them, its bad PR. For you, it could bring down your credit report.

I would have to know more information to help you. You have to make sure there was no fine print anywhere in any of your documents that indicated that such a situation was possible. Otherwise, they cannot just bind you to terms that you did not agree to.

If your attorney is unable to assist you with this, feel free to give me a call at 732/247/3340. My initial consultations are always free.
