Legal Question in Credit and Debt Law in New Jersey
I am a month behind on a credit card payment. The company called me yesterday and I answered the phone and told the person that I was unable to talk and that I will be calling back soon. He was persistent and wouldn't take that as an answer, constantly pushing me to make a payment. I had to just hang up the phone. I was immediately called back, and after about 5 more calls in rapid succession, I had to answer again.
This time, he told me that I only need to write down the confirmation number for a payment that I was making from a debit card, after trying to get him to be more clear about it, and only getting very vague confusing responses, he told me that he just needs me to confirm the expiration date of the debit card. Since there wasn't money on the card, I don't know if he was actually trying to authorize a payment without me saying so, or if he was trying to trick me into paying.
After arguing over whether or not I had the card on me to give him that information, I again had to hang up. The company continued to call me over and over and over. Within 1 hour, I had recieved 18 phone calls from them.
Tonight, I just got another 6 calls within about 5 minutes, all one after the other from them. is this legal?

Yes. The Fair Debt Collection Practices Act protects you against that type of harassment. Google "FDCPA" to find the law firms that handle harassment claims.
