Legal Question in Credit and Debt Law in New Jersey

mortgage foreclosure legalities

When notification was sent, the cure amount contained an extra $10,000.00. No explanation given-unable to reach anyone on phone number given that had any answers. By now foreclosure proceedings continued and we were still unable to get any details. There is a motion fdor summary judgement being considered. The numbers given were obviously double dipping (in error). This seems to be a clear violation of the Fair foreclosure Act. In addition to the New Jersey Fair Debt Collection Act. What remedies are available to me. My desire is ti reinstate the mortgage, This has been going on for almost a year. Payments have not been made. Had they answered one required question within the 30 days before foreclosure had begun, everything would have been over before it had begun. Thank you so much for your time and effort. I look forward to hearing from yoy.

Re: mortgage foreclosure legalities

these cases are tough. yes, the law requires them to comply with a fair number of requirements. the bottom line is that you will need some expert advice, and you will need a way to catch up on what you really do owe (which may include attorney fees and costs).

Go see a lawyer who is fairly near you, who handles lawsuits and real estate, and who has some experience with foreclosure law. It will be a bit difficult to find such a person.

I have a bit of experience, but do not make a living defending foreclosures, of course. If you would like, give me a call; I am in Hackensack (northern New Jersey). I will be happy to discuss

this with you; a brief telephone consultation will be free.
