Non payment for material and labor
I own a small flooring store in New Jersey and had recently sold a job to a developer. The job was completed on June 3rd 2008 and I was getting the run around for the past few months and have recently discovered that the developer has closed it's doors and does not exist. I have been told by my contact with the developer that I am named on the contact for the closing to be paid.
The amount that is owed to me is just under $12,000.00 and wanted to know what steps to take to make sure I get paid.

This is why you need an attorney working with you at all times. When you don't have one on retainer, you are always playing catch-up. I usually only handle small business defense work, not plaintiff. But you do need an attorney. Call John Corbett and see what he can do for you.

Unfortunately, the deadline to file a construction lien has passed. That would have been part of your best approach. Now, without a judgment, there is no guarantee that you will be paid from the escrow in spite of what you have been told. If you can get something in writing that directs the closing agent to pay you, it might be okay to wait. If not, it might be best for you to file suit now.
