Legal Question in Credit and Debt Law in New Jersey

Options after Judgement DISCOVER

My wife has 3 discover accounts that are being represented by a law firm. Two of these accounts have entered judgement. I am not sure what happens now and what my options are. We do not own a home and have no assets. Can they garnish my wages? Can they freeze any accounts that are in my name alone? We do not have enough money to pay %100 of the two judgment accounts. We just are not quite sure what to do. Thank you in advance for your time.

Re: Options after Judgement DISCOVER

Once a judgment is entered, they certainly can garnish wages against the person named on the judgment. No one else. They can try to recover from joint bank accounts. Since you have no assets to speak of, you may want to consider bankruptcy. Otherwise, they will likely keep chasing until they have obtained the entire judgment plus interest. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. If you call me, [856-546-8010] mention Law Guru and your first one hour consultation will be free. Good luck! Rob Gleaner
