Legal Question in Credit and Debt Law in New Jersey
Do I have to payback the check?
June 2006, I had received a strange check from the company I have my stock options with. I had asked them on 3 seperate occasions why I recieved this check, they assured me the money was mine to use. I even asked the last time I went to the bank. Still the same answer. June 2007 (1 yr. later) I received a letter stating the Money was not owed to me, I need to pay it back. I explained the situation. They acknowledged they understood It has been quiet until April 2008. Until then no calls, no letters, no collection attempts. This led me to believe that the problem was resolved....Now a legal firm has contacted me saying (once again) I owe the money. I gave them 3 chances to not allow this transition to happen. They allowed it. I also recieved no feedback that there was still an issue. Once again an acknowledgment that the situation was still in question. Is this lawyer right.--name removed--I need to pay the money and how can I prove I don't?
Thank you very much for your time,

If there is enough money to make it worthwhile, I suggest you hire an attorney and fight them.
I agree with what the other attorney wrote to you, you are at least entitled to the cost of whatever problems they have caused you by this.
Please call my office if you would like my assistance. I would be happy to speak to you on the telephone, but it will take more than just a brief telephone call to assist you with these issues.
My contact information can be obtained from the links below, just click on the Attorney Profile link. Let my secretary know you found me through LawGuru. This website, LawGuru, will NOT let me list my phone number in this response.

Re: Do I have to payback the check?
You may have defenses. At the least, I would look to recover any costs or expenses that you incurred because of the error (if there is an error).
You did not say the amount of the check. That will probably determine whether the case is worth defending and how much effort should be put into it.
My firm handles matters of this type, however it may be easier for you to work with a lawyer whose office is closer to you. If I can be of further help to you, call or email.
