Payment for Dental work

My daughter had 4 teeth extracted. Prior to surgery, I asked the dentist if he accepted my insurance plan and he said yes. He estimated my out of pocket to be 800. I was never given an estimated bill prior. On day of surgery I paid the 800, still never given a bill. When I got the EOB from Ins I found out he was not in network. I wrote him and requested we talk, no reply just a bill. I gave him all my ins checks. While I was waiting for the last one he tacked on 4 mon of interest, 100, and got a lawyer. I had been in contact many times to tell them they needed to send the Ins correct modifiers on their bill but he sued instead. I offered my final ins check as payment in full but he refused. Now he wants the full amount of the dental work (which I was not please with as I feel he injured my daughters neck during extractions) in addition to lawyer fees and interest. Do I have to pay the interest and lawyer fees since I kept in contact and tried over and over to explain tha t I was waiting for the ins check which was delayed because of his office. I was sent a letter from his lawyer. Do I have any legal rights? What can they do if I pay just for the dental work but not interest or legal fees? Can they continue to charge interest?

This guy is just asking for a lawsuit from you. Sorry to put it so bluntly, but he is. What you describe is just foolish.
