Legal Question in Credit and Debt Law in New Jersey

Personal debt between individuals

If a man takes a home equity loan on his home and gives it to his fiance (who lives with him) to use for her purposes, can he then hold her responsible for the debt after she no longer resides with him? She owns no part of the house and signed nothing saying such debt was hers. She did make some payments on the loan for him while still living in the home.

Re: Personal debt between individuals

It depends on the agreement between the people. If it is a gift, then it need not be repaid. If it is a loan, then it has to be repaid. Much depends on the agreement between the people, and what proof is available to show what they agreed to.
