Legal Question in Credit and Debt Law in New Jersey

Request for production of documetns

Hi, I am being sued for a lawyer that can't validate debt. SO i wanted to request discovery or production of documents.

Is there a certain format that is needed?

Just to give a brief history. The collection agency assigned a lawyer to collect. He sued me, and I answered his complaint. He is trying to settle out of court but won't produce any documents that validate debt.

In a phone conversation he asked me to request discovery....

any info would be great

Re: Request for production of documetns

Sounds like something went wrong here. You should write the CA directly and CC the lawyer and ask for proof of debt under the Fair Debt Collection Practices Act. Google that and do some research.

With regard to the attorney, you have serve him with the specific discovery request, i.e notice to produce, roggs, etc. Then if he doesn't respond, file a motion to dismiss his complaint.

You may want to get an attoreny yourself here.
