Legal Question in Credit and Debt Law in New Jersey
rights
A private collection agency accused me of owing $93,000 in unpaid child support. I immediately provided them with checks and court documentation proving their calculations wrong. The company acknowledged receipt of the documents but chose to ignore them. They consistently harassed my elderly parents (now deceased) and sister in NYC by phone even though they had my current NJ residence information. They tried to have my NJ drivers license revoked. In spite of the evidence I provided to them, they furnished the debt to the credit reporting agencies. Aside from all of the FDCPA laws the company blatantly violated in attmpting to collect the debt, the FCRA requires that a collection company must first confirm child support arrears with a ''local, state or federal government agency'' prior to reporting the debt. They didn't and that $93,000 question on my credit report has caused me and my family great financial and emotional harm. It doesn't matter that I overpaid child support by $14,000 - I am a financial consultant and have lost out on numerous job opportunities specifically due to this erroneous debt. I have been advised by the FTC, AZ Banking Dept. and the NJ Div. of Consumer Affairs to sue but can't afford a lawyer.
