Legal Question in Credit and Debt Law in New Jersey

ruined credit

My X wife owns my former home, but my name is still on the mortgage as primary. I could not get it taken off at the time of divorce. She was not suppose to laps on taxes and monthly payment. She has, now the house will forclose and ruin my credit. How can I keep from getting my name and credit ruined. The mortgage Co. will not do anything for me.Please advise.

No lawyer can solve your problem, or even give you useful advice over this computer bulletinboard. You need a lawyer to look over your agreement with your exwife, look over the situation with ownership of the house, and tell you what your options are.

You should not be in this position. Your divorce attorney should have done all that could be done to avoid it, and should have told you that this could happen.

I would need to see all your paperwork with regard to your divorce to let you know what your position is. I'd be happy to do this as part of my initial consultation with you, which is free.

I see this situation all the time and with today's real estate market, you may run into a situation where the sale of the house does not cover the mortgage. I doubt that is the case here, but its possible in some cases. You are going to have to bring her back to court and I would do it right away as you have no time to lose.

I would also guess that you may have some other issues with regard to the divorce. I suggest you have an attorney comb through it to make sure there are no other issues out there.
