Legal Question in Credit and Debt Law in New Jersey

Can I sue collectors for harrassment

My wife has a collection agency after her for a debt she does not owe. Shw was living in an apartment complex under a lease that renews automatically every year. We sent the management a notice to not renew and to pay month by month, it took 3 months to get a hold of someone and they said they never received the notice so I told them im sending the letter again and they told me its to late, the lease has been renewed. They are holding my wife liable for their irresponsibilty. I have the original copy of the letter we sent. Also they refused to release her security deposit upon her moving out. Can they do that and still try to obtain funds from us. please help me. thank you for your time and patience. -Tom

Re: Can I sue collectors for harrassment

Your wife has certain responsibilities under a residential lease in NJ, but so does the landlord. YOu might perhaps have a claim for the failure to return the security deposit, triple damages and attorney's fees. Harassment does not appear to be a strong claim.

You need an attorney to defend this. I suggest you contact an attorney near you.
