Legal Question in Credit and Debt Law in New Jersey

Superior Court Levy/Execution

I rec'd a notice from Superior Court New Jersey, Law Division, Special Civil Part, Essex County, advising that a certain amount of money has been levied to satisfy a judgement against me. I was never served with papers and have no knowledge whatsoever of what this is for. It appears to be a mortgage company, New Century Financial. What should I do?

The real question is whether the levy is against your assets. What do you hear from the bank? Court papers rarely come out of the blue. This could be an error. It could be identity theft. At this point, it is difficult to tell. There is one thing for sure: Unless you oppose a turnover of the funds in court, any money that is attached will be turned over to the creditor. So, you must act with reasonable promptness.

Since you are not familiar with SCP procedure, it would probably be best to get the assistance of a lawyer near you to help.
