Legal Question in Credit and Debt Law in New Jersey
wage garnishment
How do I prevent it? The lawyer said there is a 5000.00 owed on a credit card (including atty's fees and late charges) I am an intermittent employee and work for the state 5 mos. of the year, then go on unemployment. I am also 74 yrs. old. I am self supporting, pay 915 a month rent (apt) drive a 1999 car, pay all utilities, groc. car ins. etc all by myself. When I return to work in Feb. I can't afford a wage garnishment nor can I afford an attorney. I offered 50.00 monthly and was turned down.

ANSWER: You need to provide more information. Did they obtain a judgment against you for the debt? A wage garnishment cannot be obtained or ordered until they obtain a judgment that is docketed in the Superior Court first.
