Legal Question in Credit and Debt Law in New Jersey
Wrongful charge-off on my credit report
I had a cosmetic procedure in 2005 and paid a flat fee that was supposed to include the surgeon's, anesthesiologist's, and facility's fees. 2 months later I got a bill from the anesth group. I called the surgeon; his secretary called the anesth group; they said it was a mistake and I should disregard it. 6 months later, I got a letter from an attorney assigned to collect the debt. I wrote him back that the fee I paid was inclusive of the anesth fee and therefore I disputed the entire amount. I requested an adjustment of balance due to zero. Never heard back from him. Today I got a notice from credit monitoring service that I subscribe to that the anesth group just entered a charge-off to my account.
What are my rights? The bill was an error from the start, they told me to disregard it, then sent it to collection. I disputed it, never heard back, now the charge-off appears. I am applying for a mortgage soon and my FICO score WAS 788 until now. This erroneous debt will kill my score.
Should I call the attorney? The anesth group? Do I need an attorney, and should it be someone licensed in NJ (where the surgery was performed), NY (where the anesth group is based), or AZ (where I live now)?

Re: Wrongful charge-off on my credit report
I would suggest you at least speak to an attorney. The loan was incurred in NJ, so I suggest NJ.
