Legal Question in Criminal Law in New Jersey

2c : 35-10a

I recently was arrested for possession of under 50 grams and paraphernalia.. it is my first charge but I am disabled and have had two hips replaced and spine fusion as well as a few other operations due to my two degenerative bone disease.. I am 28 yrs old ... I smoke to reduce my pain, and to increase my appetite since I take over 12 different meds.... I am unable to get it per scribed to me due to the fact it has not passed In NJ ...6 months earlier on Jan 5th the home in which i rent a room was raided and my landlord arrested for selling and what not I was also given a possession charge for under 50 grams but was never given a court date ... the detective who arrested us stated that if I became an informant that he would help me out... But I am disabled and do not get around well so I was unable to bring him some one since I do not really know many people.... Again when I was busted on June 26th again I was told that if I helped them I would be let off easy.... Now from those two separate events I have been given a court date for Aug 21st at 1pm in municipal court... I have documented proof of my aliments and can get more if needed... But knowing from the first bust my condition would it not be entrapment ?

You do not need the good will of the police. As a first offender you are entitled to first offender treatment, involving supervision by the probation

department and then the dismissal of the charges.

You would probably qualify for favorable first-offender status on one charge, but that is less likely with 2. It is only entrapment if the police goad you into doing something that you would not otherwise have done. There is no evidence of that here. You still may have defenses, though. There ARE rules about searches and seizures. You really should speak with an attorney. Call me if you would like to discuss it further at 877*688*3879.

First off, I sympathize with the situation and would like to do whatever I can to help you get through this mess. Your real problem is that although this is a first offense and you will probably qualify for first time offender treatment, how willing are you to fight the case and try to win?
