2c:35-10c

Hi My Names--name removed--i was in a car with my friend john and his girl friend when police approached are parked vehicle the had drug up front wich admitted the were theirs. i had a 10 dollar bag of cocaine powder an swallowed it..john told him i had it!!

I finally told him i had swallowed It.

I wanted to know with out a drug crimal record could i possible get conditional discharge? Or what would be the Min down grad?? we were not read are Miranda rights..

Possession of cocaine is a third degree offense. A third degree offense carries a penalty of up to five years in state prison. There is no conditional discharge for this. You can apply for the Pre-Trial Intervention program. There may be a basis for moving to suppress the evidence on the grounds that you weren't read your rights, but I would have to see the police report before I could make a definite decision about this. Th fact that you were not read your miranda rights could be very helpful... Witht the right attorney it could easliy get you a dismissal, or at the very least the right amount of leverage to ensure that you get the conditional discharge you're seeking...

I wouldn't hang my hat on the miranda issue. You are looking at least one (if not more) felonies so you can't get a conditional discharge. I suggest you focus on getting a good attorney and let him or her decide how best to handle the case and the legal issues.
