2nd degree charges carry 5 to 10 years state prison time.

If taking $100,000 is treated as one offense, the offense is a second degree crime which has a possible,
maximum sentence of ten years in prison and the presumption of incarceration.

It is considered what is called a second degree offense. That can carry a 5-10 year prison sentence. Even for a first offender, this class of charge has a presumption of incarceration.
