Legal Question in Criminal Law in New Jersey

2c:35-10

My 17 yr old son was arrested while truant and charged with possession of one hand rolled pot cigarette, and pot seeds. First offense, but the kid he was with has a record. They were apprehended in a parked vehicle. He has a probationary driver's license. This is Camden County. What should I expect in family court? And what are my chances of having the charges dismissed with an attorney present? Im being told by the police, an attorney is not needed. thanks you

Never listen to the police. I don't know why they see the reason to give legal advice. He stands a good chance to get the case dismissed on numerous grounds. I'd be happy to discuss this with you further. Please call me at 732/247/3340.

While some cases may not be as complex as others

I would not trust the officers who arrested your

Son as to what defense he should have. If you can

Afford to hire an attorney I would, to ensure his

Record is protected as best as possible.

Re: 2c:35-10

Well, if I was about to lose my driver's license and other important rights, I'd hire a lawyer....

I've been practicing in Camden County since 1991, and I think I've got a pretty good handle on what's going on here. There would be defenses, and possible downgrades or discharges, but before I can guarantee anything, I'd want to talk to your son (privately) and the officer involved (at Court, obviously).

Feel free to call me or write back direct to [email protected] with any other questions.

Mike
