Legal Question in Criminal Law in New Jersey

2nd degree assault

I was in a fight with my gf, and hit her in the head, she had a cut on her ear. We are trying to save our marriage but am curious about what to do. She doesnt want charges to be pressed but the state is pressing them. Could she write the prosecutor on my behalf to lower the charge, or should I hire a lawyer to do so.

You can and should hire a lawyer, because the state will not stop prosecution just because the female doesn't want it to go forward. Call our offices as soon as possible.

You should get an attorney ASAP before either of you do anything. You are looking at 5 to 10 years in prison regardless of whether or not this is your first offense and you will have to serve 85% of that time.

This is a serious charge since you are facing up to 10 years in state prison as the maximum penalty on a second degree assault case. The fact that your girlfriend/wife no longer wants to proceed on the case can work to your advantage since she is the key witness for the state. If she won't testify the state may not be able to move ahead with the charge against you. Nevertheless, this is not an automatic thing and you definitely need a lawyer to help you work through the system for you.
