Depends on a variety of factors. I know many people that got a criminal record for a charge like this. Most (if not all) of my clients avoid that. A lot depends on who is handling the case, but there are other factors such as co-defendants, whether you are in a certain county that will seek jail time even as a first offender, etc. Call me at 732/773/2768 to discuss further.

A first offender for such a small amount of drugs is not facing jail and is probably eligible for

first offender treatment.

Call me if you like.

I would have to review all of the evidence before I could give you a definite answer, but based solely on what you wrote you may be eligible to apply for the pre-trial intervention program, which is a form of probation that results in the ultimate dismissal of the charge against you. Anyway you look at it, I would advise against trying to go to criminal court on your own - it is a very complex process with the potential for too many things to go wrong. You should have a lawyer with you. Please contact me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.
