Legal Question in Criminal Law in New Jersey

my 14 year old is being accused of stealing. The detective wants to question/speak with.Sounded as tho has made mind up 14 year old guilty. Can they make 14 year old speak to them alone, without parent or lawyer? If she did not do it what will happen when she does not confess to stealing? if confess will get community service and fine, otherwise we go the route i was told. she is adament she did not do it.

A parent should be present for any police questioning of your teenager. If she did not do it, stay the course. First offender juvenile convictions do not ususally result in more than probation; that is probably the worst case scenario.

There is no right more precious and more often waived than a suspect's right to remain silent. The next few weeks can mean the difference between a criminal charge or no charge at all, which may have permenant consequences for your daughter. Two things: The police can't interrogate your daughter without her parent or guardian being present and second if your daughter is innocent then she should not plead guilty to anything. Think of what a terrible thing that would be teaching your 14 year old about how the adult world works if she is forced ot plead guilty to somethng she did not do.
