Legal Question in Criminal Law in New Jersey
My 17 year old son asked to call me using his cellphone prior to signing a consent form to search our car after a motor vehicle related stop. I have found out that the Parent does not need to be notified prior to the search. However, regardless of who my son was asking to call, do the POLICE have the right to deny him access to use his cell phone at that particular time in the process? In the audio/video of the Police cams, the Police involved clearly told him that he COULD NOT use his cell phone. This is PRIOR to the search.

The prosecutor will argue that the officer acted out of concern that you son was calling for someone to assist him, perhaps violently. The officer acted appropriately
