Legal Question in Criminal Law in New Jersey
My 18 year old son was charged with 2C26-2A Disorderly person offense for a marijuana pipe in his trunk at school. It had residue and no marijuana. Drug test was negative. Is this something we can talk with the prosecutor about and is this a misdemeanor?

Yes, it is what you would think of as a misdemeanor but we don't use that term in New Jersey. Did it have residue or not? I'm not sure I understand if you are saying it does or does not. If it doesn't, I think you have a good case to get it dismissed but I doubt that the prosecutor will be helping you with that. If the prosecutor were to dismiss it, it could open the police up to a law suit. If you want to discuss further, call me at 1-855-9-JEFLAW
