Legal Question in Criminal Law in New Jersey

My 20 yr old daughter got a ticket for possession of alcohol by an underage on the Wildwood boardwalk. She had a melted down cup of ice and barely an ounce of liquid. Should she fight this, the ticket starts with 2C:_____

Also, my 17 yr old got a ticket entering Wildwood driving, for Tailgating, she is a new NJ provisional driver. She was in bumper to bumper traffic, so not sure if they can prove tailgating?

You could choose to fight any ticket or offense, winning it is another story, If she was charged with a disorderly persons offense, I believe that the fine is $500.00. If the cup contained an alcoholic beverage, it is a difficult argument. What you and your daughter should do (even if you choose not to retain an attorney) is to go to the Court and speak to the prosecutor. see if the prosecutor is willing to amend the ticket to a lower charge, lesser fine, lower penalties, It always pays to go to the Court to speak to the prosecutor.

as far as your younger daughter, tailgating is a ticket that carries five motor vehilce points. You could take a shot by trying the case based on what you said, but there are severe risks. I would have to see the discovery (evidence) in your older daughter's case, but unless the police did some type of lab test on the drink she had, they may not be able to prove the possession of alcohol charge.
