Affidavit

If a person was with someone who committed a crime and had no knowledge of what was taken place and was not envolved, but the police arrested her as well, will an affidavit from the co-defendant clear her and will it be accepted?

I seriously doubt it. I have numerous clients in this situation. The other person needs to plea out and then the State may drop the charges. Otherwise, the Co-D can always turn around point the finger back at you.

The prosecutor has to believe that with all the attendant circumstances of her arrest that the affidavit is

credible and sufficient to strongly support her being not guilty of the offense.
