Aggravated Assault First Offense

A man assaults his ex-girlfriend (the mother of his children), gets arrested, is charged with aggravated assault, and is given $15,000 bail. It is his first offense and he is a legal resident (not a citizen). He goes to court, is placed on one year probation and is ordered to return to court in three weeks. What should he expect? Deportation? A harsher sentence?

If you have already been sentenced then you should not have to go back to court on that aspect of the case. You need to find out WHY you have to go back to court before anyone can give you a definite answer to your question. You should an attorney by now. It sounds like he went to court and pled guilty without hiring an attorney and only NOW thinks about the impact on his status in this country.

This sounds really off. Why did he get probation and not PTI? I think he should review the whole case with a good attorney ASAP as this doesn't make sense. I have four offices in NJ so call me at 732/247/3340 to discuss.
