Legal Question in Criminal Law in New Jersey
Aggrevated assualt
I want to know is there a statue of limitation in the state of NJ for aggrevated assault? If you had an open case but was never charged in 2000 for aggrevated assault. The police never found you until 2005, can you still be fined or sentence for that charge?

The law is often more complex than most people realize. For most criminal offenses the statute of limitations is five years, but there are concepts which can delay the tolling of this time
period, such as a continuing offense. I need to know more about all the facts and circumstances of the incident which gave rise to the alleged offense. You might give me a call.

Prosecution of a case must begin within five years of the date the crime was committed. If the police never filed a charge against you and it has been five years or more before they try to do so, then you cannot be charged. If they charged you but just never caught you during that five year period, then you can be prosecuted. I am an attorney who has handled many cases similar to yours in various courts in New Jersey in the past. I would like to dicussy your case with you in more detail, so please call me at 908-272-0111. There is never any charge for simply talking to me. Thank you.
