Alcohol Possesion Charge

My son was in his grandpas patio an enclosed area part of the house, he was just sitting there waiting for his friends to finish smoking their pot. Well some neighbor called the police and the police walked straight into the patio one went through the window the other the door. They search my son don't find anything. Officer releases him to me saying no charges will be filed because he didn't possess anything, and if he wasn't in the back of the police car he would have just let him go. That night I get a letter from the other cop who didn't say a word to my son, that my son is getting charged with possesion of alcohol, he said my son had it in his pockets. I go down to the police station he says that he now knows my son didn't possess anything. There was like 14 beers sitting on the ground that the officers seized and charged his friend for. The officer says my son is being charged with alcohol possesion, because he was in arms reach of the alcohol. My sons at risk of getting his drivers license taken away for simply being at the wrong place at the wrong time. Any help would be greatly appreciated.

I am sorry that your family is in this situation. I believe your son may have a defense however due to the fact he was consuming alcohol on private property. You seem rather casual about your son being present while others violated the law. Being present gets you in trouble. When he sees that other are about to get into trouble he should exit, stage left.

Based on the facts as you presented them here, it sounds as if there is a good chance that this case can be beaten either through negotiation with the prosecutor or at trial.
