Legal Question in Criminal Law in New Jersey
Ammended Offense
Approx 9 years ago I was convicted of shoplifting 2C:20-11B. Recently I needed to present a certified copy of the Judgement. On it I noticed that it stated ''Amended Offense 3-7.12 Intoxicated in Public,'' What is that? Did they lessen the charge to the Amended? Also, What exactly is 2C:20-11B or where can I get that information? All there is on the net is cases...
Thanks,

Re: Ammended Offense
Based upon your reading of the document your charge appears to have been modified to a violation of a town ordinance which does not constitute theft. This is good news for your employment.

Re: Ammended Offense
Well, you are a lucky guy. The offense you actually were conivcited of was not shoplifiting. In fact, it wasn't even a disorderly persons offense, but appears instead to be a local ordinance violation.
This offense is easier to expunge, and if you should suffer another lapse in judgement and be convicted of shoplifitng, you will not be subjected to a mandatory jail sentence, as you would with a prior conviction for shoplifting.
If you want to know exactly what happened, you would have to buy a copy of the transcript or tape from the municpal hearing.
I'm sure you can find the New Jersey Criminal Code at a library, or one line. It is usually cited as N.J.S.A. 2C: etc.
