How long can it take to get a lawyer when you are indigent on an appeal ? It took one year to get the transcipts of the trial to the public defenders office. They have had it now for 5 months, and my brother still does not have a lawyer assigned to him. He was charged with Murder 1st degree, armed robbery, felony murder 1st degree, conspericy to commit murder and robbery 1st degree, possecion of a handgun for unlawfull purpose. He was never in new jersey when the murder took place . He was found guilty of a lessor included offence of aggrevated manslaughter. And also conspericy to commit murder. Aggrevated manslaughter is not murder. Can you conspire to commit aggrevated manslaughter ??? It took almost 3 years to get to court for trial. Now we are being play with on the appeal. The lessor included offence was not on his indictment . It state in notes #1 that on homicide charges lessor includeds should not be used. . You can find it under model jury charges non2c 038.

The trial was in New jersey

I suggest you call the PD's office to find out. It should not take that long as the appeal has to be filed by a certain date.

You could always hire a private attorney for him.
