Legal Question in Criminal Law in New Jersey

Application for Firearms Purchaser ID Card / Handgun Purchase Permit:

On the sts-033 application form it asks:

1) Have you ever been convicted of a disorderly persons offense in NJ where you could have been sentenced up to six months in jail?

2) Have you ever been convicted of a crime (felony) in New Jersey where you could have been sentenced to more than six months in jail"

NJ Crimes are broken down like this:

1st degree

2nd degree

3rd degree

4th degree

Disorderly Persons Offenses

Petty Disorderly Persons Offense

Municipal Ordinances

I have been charged with a Municipal Ordinance in NJ a few years ago; typical ordinances include a fine up to 1200 and can include up to 30 days in jail. These are offenses that each town sets such as loud noise, disrupting the peace, littering, urinating in public. I did not have to attend court (but did to talk to the prosecutor about it) and just paid a fine. Do I have to list this on the Gun Permit Application in NJ?

Since they did not ask for records of municipal ordinance violations then you do not have to list it.
