arrest for having paint ball in car

My 18 yo son was arrested for having a paint ball gun in the car and using it to shoot signs. He was arrested at 11:00 pm and did not get to make a call until 7:30 am.

Is this legal. We are in Hamilton, Mercer County.

If the paintball gun is capable of inflicting bodily injury it might be regarded as a handgun which can not be possessed lawfully without a gun permit.

If the paintball gun was used to damage the property of another that fact would support a charge of malicious mischief.

Being eighteen years of age when the offenses were allegedly committed requires that your son be treated as an adult and not as a juvenile.

The arrest is legal as apparently there has been some property damage done so there will be complaining witnesses. The fact that he was held for so long without a phone call may sem excessive but the officers will probably say it took that long to process him because it was the overnight shift.
