Legal Question in Criminal Law in New Jersey

Cause for arrest

I had a question about what proof cops would need to arrest someone for selling drugs to an informant. Basicly my concern is a friend of mine asked to borrow money on two occasions a few months ago and i met him and gave it to him. He used to sell drugs before and i know he had been arrested before but that was a few years ago. I was just wondering if someone could just say they bought drugs from someone would that be enough proof for an arrest or would it have to be recorded or taped or have an undercover cop witness it.

Re: Cause for arrest

You have several questions going on at once, so I'm going to take them out of order. First, if you are giving money to someone that is selling/buying drugs then you can be charged as an accomplice as you are providing the means for him to buy the drugs.

Next, there is a difference between being arrested and being found guilty. You can be arrested for anything, whether the arrest is legal or not is a diffent story. Furthermore, the standard of proof is much, much lower then what is required to find you guilty at trial.

Finally, I do not see you being arrested just based off of someone's word. There has to be some corroboration, but that doesn't have to be on video tape.

However, its never too early to see a lawyer, I suggest you see one to discuss your options.
