The arrest will be on your record until you complete first offender treatment; wait six months after the dismissal of the charge and then file with the Superior Court of New Jersey to expunge your record.

It depends on two (maybe three) different things. The first is, you have only been arrested, not convicted. If you are convicted, then you will have a criminal record that your employer could discover. However, secondly, if you have never been convicted of any drug crimes before in any state, then you can apply for and probably get accepted into a probationary program that will result in the charge against you being dropped once you complete probation so you would not have a criminal record. Even after either of these is done you would still have an arrest record which would need to be expunged (cleared off your record). Finally, there is a possibility that you will just be found not guilty of the charge - I would have to review the evidence in your case to see if this is possible. Still, if you are found not guilty, you would have an arrest record that needs to be expunged. I handle this type of case all the time. Please contact me for a free consultation. Thank you.
