Simple assault occurs when one attempts to cause, or actually causes, bodily injury to another, or puts someone in fear of imminent serious bodily injury. Its general basic meaning is that the defendant hit someone, but that the outcome/potential outcome was not serious harm. If serious harm occurred, or if the victim was a policeman, etc., then the charge is generally Aggravated Assault.

Simple assault in New Jersey is a disorderly persons offense which is equal to a misdemeanor in other states. Generally, the penalties are fines, although the judge has the ability to impose a short jail sentence or community service based on the facts of your case.

The good news, however, is that you may be able to arrange a plea to a lesser charge or, based on the facts of your case, may be able to successfully defend the charges.
