Legal Question in Criminal Law in New Jersey
Assault Victom
I was a victim of an assault by a martial arts school owner who holds a 2nd degree black belt. I have no martial arts or any type of fighting skills. I had called him in the morning regarding a business transaction when he freaked out and threatened to hurt/kill me. Later that day he waited near my home for me and as I pulled into the neighborhood, cut me off, pulled me out of the car and beat me. He sped off only when he noticed a witness. I went to the ER suffering from a black eye, facial swelling, but no broken bones or serious injuries. My sworn statement matches the witnesses and his is a ridiculous story about how I ''set him up''. The police investigator recognizes his bogus story and has added false swearing to the charges of simple assault, improper behavior and ciminal mischief as he damaged my car in excess of $500. The police report is under review by the prosecutor's office to determine the final charges. I had no chance of defense, threw no punches & tried to just get away. Is this simple assault given the fact that he's a trained fighter/killer? Should I await word from the prosecutor or try to meet with them now? What are my chances of damages in a civil suit?

The local police and county prosecutor's office will determine the appropriate criminal charges in this matter. Based on your email it appears they are on the right track. You will want to seek medical attention as this may affect the degree of criminal charges herein, as well as the amount of your potential civil damages. To that end, my firm may be interested in representing you in a civil suit. Feel free to call or email us 24/7.
