Legal Question in Criminal Law in New Jersey
I was assaulted in my home by my ex boyfriend, his brother, and their cousin. These people were not invited into my home and entered unlawfully. As a result of the assault I suffered a fractured skull and six stitches to my upper lip. I now have to wear glasses and have a permanent scar from the stitches. My ex was charged with domestic violence and the other two received simple assault and trespassing complaints. I did not go to the hospital after the attack because my son was taken and I was more concerned with his return than going to the hospital so I went the next day. My question is given the extent of my injuries can I have the charges upgraded to aggravated assault and how do I go about doing so in NJ?
