Legal Question in Criminal Law in New Jersey

assulted on my college campus by another student

I was assaulted on my college campus and they aren’t really disciplining the person. I was told by the dean in charge of the situation that because the person didn’t hit me with an open hand I can’t call it assault and if I were to contact the police they would leave it up to the college to take care of the situation because it’s a domestic issue. I was wondering if I did indeed contact the police what would happen because I think this issue is beyond just what happened to me?

Your dean may prefer to handle the matter internally but it would be difficult to determine from the few facts given regarding the assaultive behavior. You can always talk to the police to get their view. It is more critical if you were injured and had to seek medical attention or the like; or it might even be a harassment situation under the criminal statute despite contact such pushing, hitting or shoving. I do not understand the domestic characterization by the dean.
