Legal Question in Criminal Law in New Jersey
The attorney that represented my husband years ago has now taken on a case for the defense against us. He also, represents other family members of ours could this be a conflict of interest?

A conflict of interest is just the appearance that a lawyer MAY use some confidential information obtained while representing a party against that party in another legal matter where he represents someone else. The issue should be brought to the attention of the judge handling the matter so that the question of a conflict of interest can be resolve BEFORE something of substance happens in the pending matter.
