Legal Question in Criminal Law in New Jersey

backround check for employment

I was arrested for possession of Marijuana in 1993. I was told that if I stayed out of trouble for 6 months, the charge would be expunged from my record. Recently I learned that it was dismissed, not expunged. I want to work for a School District which requires a Fingerprint Scan/ Background check. Am I able to work for the School, or will I be disqualified?

A dismissed criminal charge is not supposed to be used in determining employment. If you want an expungement

That's up to the school with regard to what their policy is and how deep of a check they do. Most just check the county records in which case your record wouldn't show up.

I would have to pull your criminal record to see what it says. It may show up as an arrest and a dismissal. Thus, it may still be there. You can get that removed if you'd like. I would suggest getting an attorney to help you with as the process can be complicated for a lay person to handle.
