Legal Question in Criminal Law in New Jersey
A big mess
I was charged with robbery, Their is no physical evidence, only two witnesses (Husband & wife/Co-workers) saying I was acting nervous before the robbery occured where I was working. The following day I was arrested on a $50,000.00 warrant and incarcerated. After several days I was visited at the jail by a detective and questioned, I gave incriminating statements and also fingered someone as the gunman. Now my question is was there enough probable cause for a warrant. I would think that would only be enough to question me. Also the two witnesses have changed their statements saying that I was acting nervous after the robbery (On record). When I gave my statement to the detective at the jail he did not read or have me sign any miranda rights and they never did record or have me write a statement just verbal. Do I have a good chance of getting my statement surpressed? or the whole case dismissed due to the two witnesses changing their statement? There is nothing else as far as evidence just what I mentioned above. I'am looking for counsel in my area that is willing to work out a payment plan or pro-bono if possible. My case is in Bridgeton infront of judge Waters and prosecuter Berriosford. Thank you for your help.

Hard to give an informed opinion just on what you wrote, but if that was all they had to get a warrant, I agree, it ain't enough.
If he didn't "Mirandize" you, you do have a good chance of getting the statements suppressed.
Recanting witnesses or ones who change their story are a great thing for a defense. You would probably have to go through a trial to get a dismissal, though.
