Legal Question in Criminal Law in New Jersey
My boyfriend was charged with (4 counts) 1.shoplifting-take, carr ~2. shoplifting-take, carr ~3. crim attempt-substan ~ 4. conspiracy. He has a criminal past, but what are the chances of getting this down graded to a lesser charge that doesnt carry jail time? He and a friend was caught on tape. Although the friend is the one that actually did all the stealing and conceiling. My boyfriend pushed the shopping cart out of the store, but he actually never touch any of the stolen items. He also did infact drive the friend to the store. But again, he never touched any of the stolen items. Does my boyfriend have a good enough case to get it down graded to a lesser charge? Also my boyfriend past does not include shoplifting or theft, and his friend has several shopliting/theif charges from the past.
