Legal Question in Criminal Law in New Jersey

my boyfriends was fired from his job july 15th 09. the reason was theft of less than $200, double swiping credit cards. Tonite the local police called today told him that they need him to come down to get finger prints, pic and court date! But they told him he is not being arrested! Is this a normal thing? I am confused and really could use some advise!

Sounds like he needs to be "processed" which is part of the arrest process but can also happen without an arrest. The more important thing that both of you should be worried about is the case itself. I suggest meet with a good attorney that can help protect him. Call me at 732/247/3340.

If he needs to go to Court, he has to answer to the charges.

He was "arrested" because he wasn't free to leave the police station until they were done with him.

This is serious, and he needs to get a lawyer to defend him. If he doesn't, he'll wind up with a conviction to go along with the arrest.

He is charged with theft and should work to limit the damage caused by this charge. On a minor theft charge it is customary to issue a summons and not a warrant, which only requires a court appearance, instead of paying bail to be released. If he surrenders to the police it is likely that he will be issued a summons and released, but it would be unwise to refuse to surrender to the police as requested.

He should surrender, but avoid making any statement until he has hired an attorney.
