brother arrested for 2nd degree assault.

my is brother been charge for 2nd degree assault.someone got hurt on a fight that happened outside the house that he went to.hes just one of the spectator that watching the fight but when decide to break the fight cops came everyone start running and he ran with them but got caught plus other 2 guys.but when the cop to the guy who got beat up at the fight and ask if hes one of them the victim said no but the cop still arrested him.my brother said hes not involve at the fight.theres no hearing date yet they just sent him a complaint and what hes charge for.my brother doesnt have any prior records.Is my brother in big trouble?we dont have money to pay for a good lawyer can we trust the lawyer that the court will provide us?we need some help.

As a part time pool attorney for the Essex County Public Defender's Office, you can generally trust the lawyer they assign.In my opinion some of the best criminal attorney are public defenders. However, public defenders are overworked and usually can not devote the same amount of time to an individual case as a private attorney can. 2nd Degree Assault is a serious charge with a potential sentence of 5-10 years with a mandatory 85% wihout parole. However, based upon the facts you provided, and given your brother's record a more favorable resolution is possible. If convicted, he is looking at 5 to 10 years regardless of his lack of record. He will have to serve 85% of that time before he can be let out. I suggest you do everything you can to find him a good attorney. Many attorneys (myself included) take credit cards so if you know 10 people that have $500 to spare on a credit card, then you are in good shape; for now anyway.

When his case is over and he has sufferred a bad result it will be too late. He needs to hire an attorney.

Your brother is in big trouble. He could find himself serving eighty-five percent of a ten year sentence.
