Burglary charges
My brother who has prior convictions none for burglary is being charged with several counts of burglary charges. There is no physical evidence that puts him at the scence of the crime, only a testimony of a ''friend'' who was actually involved in the crimes. The testimony of this accomplice says she merely drove him and another person to the scene of the crime several times, but did not enter the homes. My brother does not have a good record at all and has had a history with drugs. His public defender seems very uninterested in his case and is reluctant to give me any information about his case. I want to know how could he be found guily with the only evidence is ''hearsay'' from a prior criminal? I may be interested in retaining an attorney for him at this time instead of using the public defender. Any insight would be great.

I would have to review all the discovery (evidence) in the case before I could give any advice about a case. In general though, the prosecutor needs to have some amount of evidence before they can proceed on a case. There are people sitting in prison right now because one person said that someone else did and/or said something without any other evidence. It takes a good attorney to fight for the defendant. It would seem that your brother has a problem because someone is saying he was present and entered the house that was burglarized. He could trying the case, but only if he was not there and was not involved. Defendant's with a history of drug abuse are of little use to their case, if they chose to testify.
